BOUNCEinc Conditions of Sale
These Conditions of Sale apply to any ticket or product purchased via the BOUNCEinc website, Contact Centre, or in venue, and bind you as the Customer and any Participant you book for. By selecting I Agree during checkout, you confirm that you have read, understood, and accepted these Conditions, including all in venue terms.
Important Notice – Please Read
Exclusion of liability. Waiver of right to sue. Your assumption of risk. These Conditions affect your legal rights.
1. Terms of Use for BOUNCEinc Facilities
Recreational Activities and Risk Disclosure
1.1 BOUNCEinc sells tickets and offers access to recreational activities including trampolining, lessons, parkour, foam pits, the wall, bag jump, volleyball, x park, clip n climb, cliff jump, stairway to heaven, leap of faith, vertical slide, x run, high ropes, miniBOUNCE, toddler zone, dodgeball, performance area, and free jump.
1.2 Participation involves significant risk including serious injury or death. By purchasing a ticket, the Customer and Participant acknowledge and voluntarily assume all associated risks.
1.3 Risk Warning: Use of equipment or participation in activities may result in serious injury or death. All participation is at your own risk.
Limitation of Liability
1.2.1 BOUNCEinc, its related companies, employees, directors, agents, affiliates, and subsidiaries will not be liable for any injury, death, loss, damage, or claim arising from participation except where caused by gross negligence or wilful misconduct.
1.2.2 BOUNCEinc provides no warranties regarding the quality, safety, or fitness for purpose of its activities or equipment.
Indemnity
1.3.1 You agree to indemnify and hold harmless the Released Parties from any claim, action, loss, damage, or cost including legal fees arising from:
• Your participation or that of any Participant
• Any breach of these Conditions
• Any misrepresentation during booking
Health and Safety Requirements
1.4.1 All Participants must be in good health and free from conditions that may be aggravated by physical activity including pregnancy, pre existing injuries, medical conditions, or wearing casts. Seek medical advice if unsure.
1.4.2 BOUNCEinc may refuse entry or participation for safety reasons.
1.4.3 In case of injury, BOUNCEinc may arrange emergency medical care or ambulance services, and the Customer is responsible for all associated costs. Refusal of assistance releases BOUNCEinc from liability for consequences.
Supervision of Minors
1.5.1 Children under 12 must be accompanied and directly supervised by a responsible adult.
1.5.2 A parent or guardian is deemed to have accepted these Conditions on behalf of their minor child when booking.
1.5.3 If a minor claims to be 12 or older when purchasing a ticket independently, BOUNCEinc may rely on that representation. Responsibility for accurate disclosure remains with the minor and guardian.
Ticket Terms
1.6.1 All tickets are non refundable, non transferable, and valid only for the specified date.
1.6.2 Tickets may not be tampered with, altered, resold, or exchanged.
Authorised Agent and Group Bookings
1.7.1 When booking for others, you confirm that you are their authorised agent and that they accept these Conditions.
1.7.2 You warrant that you have obtained their consent and indemnify BOUNCEinc for any claim arising from such bookings.
Images and Media
1.8.1 Entry into a BOUNCEinc venue implies consent to photography and video recording for security and promotional purposes.
1.8.2 You grant BOUNCEinc the right to use such content without compensation.
Website Terms
1.9.1 Use of the BOUNCEinc website is subject to the Website Terms of Use, including provisions on intellectual property, third party links, security, and liability.
Governing Law and Jurisdiction
1.10.1 These Conditions are governed by the laws of the Republic of South Africa.
1.10.2 Disputes fall under the exclusive jurisdiction of South African courts.
Consumer Protection Act Notice
In compliance with Section 49 of the CPA, you are notified that:
• These Conditions limit BOUNCEinc’s liability
• You waive certain rights and assume significant risk
• You indemnify BOUNCEinc
• You confirm acceptance by selecting I Agree
2. About the Website
2.1 Use of the Website indicates acceptance of these Conditions.
2.2 The Website is provided by BOUNCEInc (Pty) Limited.
2.3 BOUNCEinc is not responsible for third party websites linked via the Website.
2.4 Third party advertisements may appear and are not endorsed by BOUNCEinc.
2.5 Copyright in the Website belongs to BOUNCEinc or its licensors.
2.6 Trade marks and logos remain the property of their owners.
2.7 Copying or use of Website intellectual property is prohibited.
2.8 BOUNCEinc may limit or discontinue Website access. These Conditions remain binding regardless.
3. Ordering Procedure
3.1 You may offer to purchase products at the prices listed.
3.2 Your order must include name, phone number, email, payment details, and required information.
3.3 Payment is via credit card on the Website.
3.4 A confirmation email will be sent once payment clears. Contact 011 517 2500 if not received within two business days.
3.5 Orders cannot be cancelled after submission and payment.
3.6 Phone and in venue orders are also subject to these Conditions except online specific clauses.
4. Pricing
4.1 Prices are invitations to purchase and may change without notice.
4.2 Prices are in South African Rands and must be paid in full unless a discount applies.
4.3 E and OE.
5. Cancellation Due to Error or Unavailability
5.1 Errors may occur and BOUNCEinc may cancel a transaction even if confirmed.
5.2 If your card has been charged, you will receive a full refund.
6. Conditions Applying to Purchases
Details may change without notice due to legislation, though such changes will not materially affect purchased products or services.
7. Order Submission and Agreement
Selecting I Agree confirms acceptance of these Conditions. You are responsible for ensuring order accuracy. BOUNCEinc will confirm your order within two business days.
8. Security Policy
8.1 Financial details are processed through a secure server.
8.2 Internet transmission is not fully secure. BOUNCEinc cannot guarantee security and accepts no liability for loss due to transmission.
8.3 BOUNCEinc will take reasonable steps to preserve information security once received.
9. Law and Jurisdiction
These Conditions are governed by South African law. If any part is unenforceable, the remaining parts remain valid.
