BOUNCEinc CONDITIONS OF SALE
These Conditions of Sale (“Conditions”) apply to any ticket or product purchased via the BOUNCEinc website, BOUNCEinc Contact Centre, or in a BOUNCEinc venue, and bind you (“Customer”) as well as any other person for whom you make a booking (“Participant”). By ticking the “I Agree” checkbox during the online checkout process, you acknowledge that you have read, understood, and accepted these Conditions, including the terms contained in our In-Venue Terms and Conditions.

1. Terms of Use for BOUNCEinc Facilities
Recreational Activities and Risk Disclosure
1.1. BOUNCEinc (Pty) Limited, trading as BOUNCEinc or BOUNCE (“BOUNCEinc”), sells tickets and provides access to recreational activities including, but not limited to: trampolining, trampolining lessons, parkour, parkour lessons, foam pits, the wall, bag jump, volleyball, x-park, clip ‘n climb, cliff jump, stairway to heaven, leap of faith, vertical slide, x-run, high ropes, miniBOUNCE, toddler zone, dodgeball, performance area, and free jump area (“Recreational Activities”).
1.2. Participation in these Recreational Activities involves significant risk, including serious injury or death. By purchasing a ticket, the Customer and/or Participant acknowledges and voluntarily assumes all risks associated with these activities.
1.3. RISK WARNING: The use of any equipment or participation in any activities at BOUNCEinc venues may result in serious injury or death. All Participants engage in such activities at their own risk.
Limitation of Liability
1.2.1. BOUNCEinc, BounceIncSSA Limited, Bounce Australia (Pty) Limited (ACN 154 220 569), their employees, directors, agents, affiliates, and subsidiaries (“Released Parties”) shall not be liable for any injury, death, loss, damage, or claim, whether direct or indirect, arising from your use of or participation in Recreational Activities, except where such loss arises from gross negligence or wilful misconduct.
1.2.2. BOUNCEinc provides no warranties, express or implied, regarding the quality, safety or fitness for purpose of its activities or equipment.
Indemnity
1.3.1. You agree to indemnify and hold harmless the Released Parties from any claim, action, loss, damage, or cost (including legal fees on an attorney and own-client basis) arising out of:
- Your participation or that of any Participant in the Recreational Activities;
- Your breach of these Conditions;
- Any misrepresentation made during booking.
Health and Safety Requirements
1.4.1. All Participants must be in good health and free from any condition that may be aggravated by physical activity (including pregnancy, pre-existing injuries or medical conditions, or wearing casts). If unsure, seek medical advice.
1.4.2. BOUNCEinc reserves the right to refuse entry or participation for safety reasons.
1.4.3. In case of injury, BOUNCEinc may arrange emergency medical treatment or ambulance services. The costs of such treatment or services shall be for the Customer’s account. If the Customer or Participant refuses such assistance, BOUNCEinc shall not be liable for any resulting consequences.
Supervision of Minors
1.5.1. Children under 12 years of age must be accompanied and directly supervised by a responsible adult.
1.5.2. A parent or legal guardian will be deemed to have accepted these Conditions on behalf of their minor child by proceeding with the booking and ticket purchase online.
1.5.3. Where a minor purchases a ticket independently and claims to be 12 years or older, BOUNCEinc may rely on that representation in good faith. The responsibility for accurate disclosure lies with the minor and/or their legal guardian. BOUNCEinc shall not be held liable for any false representations of age or resulting consequences.
Ticket Terms
1.6.1. All tickets are non-refundable, non-transferable, and valid only for the date shown.
1.6.2. Tickets may not be tampered with, altered, resold, or exchanged.
Authorised Agent and Group Bookings
1.7.1. If you make a booking on behalf of another person or group, you confirm you are their authorised agent and that they accept these Conditions.
1.7.2. You warrant that you have obtained their full consent and indemnify BOUNCEinc against any claim arising from such bookings.
Images and Media
1.8.1. By entering a BOUNCEinc venue, you consent to photographs and video recordings being taken for security and promotional purposes.
1.8.2. You grant BOUNCEinc the right to use such content without compensation.
Website Terms
1.9.1. Use of the BOUNCEinc website is subject to the separate Website Terms of Use, which include clauses regarding intellectual property, third-party links, security, and liability disclaimers.
Governing Law and Jurisdiction
1.10.1. These Conditions are governed by the laws of the Republic of South Africa.
1.10.2. Any disputes shall be subject to the exclusive jurisdiction of South African courts.
NOTICE UNDER THE CONSUMER PROTECTION ACT (CPA)
In compliance with Section 49 of the CPA, you are hereby notified that:
- These Conditions limit BOUNCEinc’s liability;
- You waive certain rights and assume significant risk;
- You are indemnifying BOUNCEinc from claims;
- You confirm that you understand and accept these Conditions by ticking the “I Agree” box.
2. ABOUT THE WEBSITE
2.1 By using the Website, you agree to these Conditions of Sale.
2.2 The Website is provided by BOUNCEInc (Pty) Limited trading as BOUNCEinc.
2.3 BOUNCEinc is not responsible for third party websites linked via the Website. Use them at your own risk.
2.4 Third party advertisements may appear on the Website. BOUNCEinc does not endorse or recommend any advertised products or services.
2.5 Copyright in the Website is owned by BOUNCEinc or its licensors.
2.6 Trade marks and logos on the Website belong to their respective owners.
2.7 Copying or use of any intellectual property from the Website is strictly prohibited.
2.8 BOUNCEinc may discontinue or limit Website access at any time. These Conditions of Sale remain binding even after termination.
3. ORDERING PROCEDURE
3.1 You may offer to purchase BOUNCEinc products for the price listed on the Website.
3.2 Your order must include name, phone number, email, credit card details, and any other required info.
3.3 Payment is made via credit card through the Website.
3.4 Confirmation of your purchase will be sent by email once payment clears. If not received within two business days, contact the Contact Centre on 011 517 2500.
3.5 Orders cannot be cancelled after submission and payment.
3.6 Orders placed by phone or in-venue are also subject to these Conditions of Sale, excluding those specific to online purchases.
4. PRICING
4.1 Prices listed on the Website are invitations to purchase and may change without notice.
4.2 Prices are in South African Rands and must be paid in full unless a Website discount is applied.

5. CANCELLATION DUE TO ERROR OR UNAVAILABILITY
5.1 Despite all precautions, errors may occur. BOUNCEinc reserves the right to cancel a transaction, even if confirmed.
5.2 If your card has already been charged, a refund will be issued for the full amount.
6. CONDITIONS APPLYING TO PURCHASES
Details may change without notice in accordance with legislation. Changes will not materially affect purchased products or services.
7. ORDER SUBMISSION AND AGREEMENT
Clicking “I Agree” confirms acceptance of these Conditions of Sale. You are responsible for the accuracy of your order. BOUNCEinc will confirm your order within two business days.
8. SECURITY POLICY
8.1 Financial details are processed through a secure server.
8.2 Internet transmission is not completely secure. BOUNCEinc cannot guarantee security of transmitted data and accepts no liability for any loss suffered due to transmission.
8.3 BOUNCEinc will take reasonable steps to preserve the security of your information once received.
9. LAW AND JURISDICTION
These Conditions of Sale are governed by South African law. If any provision is unenforceable, the remaining provisions remain valid and enforceable.
